सक्षिप्त हालात मुकदमा इस प्रकार से है कि दिनांक 6-3-2019 को पुलिस पार्टी मुकाम ख्वारा चौकी रोड NH -5 लिंक रोड Industry area में गश्त ड्यूटी पर थे तो समय करीब 6.30/6.40 सायं के बीच पुलिस को एक आदमी बैग उठाये आता दिखाई दिया जो पुलिस को देख कर घबरा गया शक होने पर पुलिस ने रोक कर नाम पता पूछा जिसने अपना नाम अशोक शर्मा पुत्र श्री बाल कृष्ण शर्मा गांव कदौरा डा0 आन्जी ब्राहमणा तहसील व थाना कण्डाघाट जिला सोलन हि०प्र० व उम्र 36 साल बतलाया।
The Ld. District & Session Judge (Forest) Shimla Sh. Jaswant Singh, has convicted the accused Ashok Sharma, aged 36 years, S/o Sh. Bal Krishan Sharma, R/o Kadaura, P.o Anji, Teh. Kandaghat, District Solan, H.P., vide judgment dated 20-02-2024, in case FIR No. 37/19, dated 06-03-2019 U/s 21 NS&PS Act P.S West, District Shimla, H.P.
The brief facts of the case are that on 06-03-2019 when the police on the patrolling duty at Khwara Chowki Road, NH Ravinda Link Road Industry Area, than at around 6.30-6.40 PM they have noticed a boy which was coming from the side of Industrial area and also holding a bag. The boy got perplexed when he saw the police party. The police had nabbed the boy and checked the carry bag in which 12 grams of Chitta was recovered. The police lodged FIR under Section 21 of ND&PS Act against the boy namely Ashok Sharma. During the course of trial 12 witnesses were examined by the Prosecution.

बैग की तलाशी के दौरान बैग के अन्दर से 12 ग्राम चिट्टा हेरोइन बरामद किया गया। इसके उपरान्त पुलिस ने थाना बालूगन्ज मे मुकदमा न0 37/19 दर्ज करके आरोपी अशोक शर्मा के खिलाफ 21 ND&PS Act के तहत मामला दर्ज किया। अदालत में अभियोजन पक्ष की ओर से 12 गवाहों के बयान कलम्बन्ध किये।
श्री कपिल मोहन गौतम जिला न्यायवादी (वन) शिमला ने मामले की पैरवी की। श्री जसवंत सिंह ठाकुर की विशेष अदालत (वन) शिमला ने आज दिनांक 20 फरवरी 2024 को साक्ष्यों को मध्यनजर रखते हुए आरोपी अशोक शर्मा को 5 साल का कठोर कारावास व 1 लाख रुपये का जुर्माना तथा जुर्माना अदा न करने की सूरत में आरोपी को 1 साल का अतिरिक्त साधारण कारावास का फैसला सुनाया।

Jaswant Singh has convicted the accused for the possession of 12 grams of Chitta with the sentence of 5 years imprisonment and fine of 1 Lac rupees and in default of payment of fine the accused shall also undergone simple imprisonment of 1 year. The case was conducted by Sh. Kapil Mohan Gautam, District Attorney (Forest) Shimla, H.P.
