Is yellow line parking on national highway possible in Shimla, High Court asks NHAI

The Himachal High Court has asked the National Highways Authority of India (NHAI) whether it will be possible to draw white or yellow lines on the national highway to cater to the parking needs of the citizens of Shimla on a payment basis.

The court directed the counsel for the NHAI to obtain specific instructions in this regard and furnish information on or before the next date of hearing.

During the course of hearing, the court was informed that in compliance with its earlier order regarding setting up of a transport nagar for relocating automobile repair/denting painting shops functional in Shimla city, the government has placed on record a communication issued on December 30 by the Additional Chief Secretary (Industry) to the Deputy Commissioner, Shimla, informing him that the department had examined the matter regarding the transfer of land for the purpose and decided to convey the 'NOC' in this regard.

While taking on record the communication, Justice Tarlok Singh Chauhan observed that "it is expected that necessary consequential steps for the establishment of transport nagar will now be taken as expeditiously as possible and preferably before the next date of hearing" and listed the matter for hearing on March 20.

The court also directed the Commissioner, Municipal Corporation, to produce the entire record of street vendors and also file a supplementary affidavit clarifying its position that how the numbers of street vendors swelled from 598 to 1,065 within two years.

While passing this direction, the court observed that "it appears that the Municipal Corporation has been misleading the court with regard to the data of the actual number of street vendors (teh bazaris) in the municipal area". The court passed the orders on a petition highlighting the parking and other local issues.
