HC relief for HPPSC member

In a relief to Dr Rachna Gupta, a member of the HP State Public Service Commission, the High Court has restrained a resident of Noida for allegedly tarnishing her image on the Facebook.

Justice CB Barowalia passed the order last week on a defamation suit filed by Rachna against Devashish Bhattacharya. Passing this order, the court observed, "A prima facie case is in her favour and taking into consideration the facts and circumstances, the defendant is restrained from posting or publishing any statement of any nature, against her and her family members on the Facebook or on any other social media, including print or electronic media, till the disposal of the main suit/case."

In the case, she alleged that the posts were irresponsible and libellous in nature constituting defamation.

Rachna alleged that by posting such defamatory posts, the defendent had tried to tarnish her image. In the case, Rachna had claimed Rs 1 crore from him. However, it was contended on behalf of Bhattacharya that he had not post any defamatory posts against her on any social media.

It was further alleged that the act was civil as well as criminal in nature, which caused agony to the plaintiff. — OC
