Under the new provisions in the bill, there would be a single law to plan and regulate real estate sector activities. To avoid haphazard and unplanned development in the state, all such areas where development of apartments and colonies are proposed shall be deemed planning area and will be regulated under the new law.
Urban development, town and country planning minister Sudhir Sharma said that at present any person building five or more apartments was required to be registered as promoter. The limit has now been increased and anyone constructing more than eight apartments would be required to register as promoter.
The owners of land more than 1000 square meter were covered under the definition of colony and required to register as promoters. Now, this limit has been increased to 2500 square metre, he said. He said provision for mitigating disasters has also been made by incorporating necessary provisions for soil investigation report and structural design basis report as per provisions for safety against natural hazard in consonance with the disaster management directives of the Union ministry of home affairs. At least 25% of the developed land in all housing projects shall be earmarked for economically weaker sections, lower income groups of society and bonafide Himachalis.
Conditions for registration as promoter and penalty provisions for violations have been made more stringent, including demolition and fine. In case of non-compliance, the cost involved in demolition shall be recovered from the violator. Provision has also been made for obtaining essentiality certificate.
